NOTE ON AMENDMENTS MOVED BY BRINDA KARAT ON THE CrPC AMENDMENT BILL

  • In Para 3 of the bill the insertion of the new proviso to S24 CrPC should be amended to read as under: 

“Provided that the Court shall permit the victim to engage an advocate of her/his choice to prosecute the case on her/his behalf”

  • In Para 30 of the bill in the proposed table which makes certain offences compoundable by specified persons the following offences should be deleted:

 

  • Criminal breach of trust- 406
  • Assault or criminal force to woman  with intent to outrage her modesty- 354
  • Uttering words or sounds or making gestures or exhibiting any object intending to insult the modesty of a woman or intruding upon the privacy of a woman- 509
  • Marrying again during the lifetime of a husband or wife- 494
  • In the table in Para 30 the following amendments should be made:

 

Enticing or taking away or detaining with criminal intent a married woman- 497

  • The provision for a scheme of compensation envisaged as S357 A should not be dependent on recommendations made by the court etc but a separate autonomous body should be set up under an act to decide the quantum of compensation to be given to victims of crimes Additionally the Court should give the fine leveled on the accused to the victim.
